2. Orders

"Good for agreement", or any document stating an order with SkyView Innovation

3. Delivery delay
SkyView Innovation hereby undertakes a simple obligation of means as to respecting
the delivery dates. However, possible delays that could be attributable to SkyView Innovation
due in particular to weather conditions ... will not give the customer the right to cancel
or refuse the design and execution of the project or services designated on commercial
documents and will not be entitled to damages and interests. Delivery of the project
or services designated on the commercial documents can only intervene if the client
is up to date with his obligations to SkyView Innovation.
4. Payment conditions in the absence of a specific agreement
Customer agrees to pay SkyView Innovation invoices in full within thirty (30) days
from the invoice date. No discount will be granted in the event of early payment.
5. Property retention clause
The prices indicated on the commercial supports are heard in Euro and these can
be changed at any time by the publisher. The prices displayed are only valid on
the day of the order and are not effective for the future.
The price applicable to the customer is that in force at the time of the order.
Any costs delivery will, in any event, be indicated to the user before any payment.
Products sold, deliverables or digital files from a service remain the property of the seller
until full payment of their price, in accordance with this clause of retention of title.
In the absence of payment by the customer, of all or part of the agreed price, within
eight (8) days of the date of presentation by registered letter with notice receiving
acknowledgment of said defect and serving as a formal notice to remedy it within
the same period, the order and all orders in progress will be automatically terminated.
6. Cancellation
Any order accepted and canceled using a tool leaving a written record addressed to
SkyView Innovation, subject to return of an acknowledgment of receipt, without respect
72 hours notice prior to the execution of the ordered project will be billed in full.
Any accepted order which has been the subject of a deposit cannot be canceled,
except in cases of force majeure or express agreement. SkyView Innovation will be entitled
to invoice the full price as compensation, without affecting their ability to sue to claim
damages in the event that damage is greater than the order would be demonstrated.
7. Late payment penalties by the customer
Any amount not paid by the due date will automatically result in a late payment penalty.
3 times the legal interest rate for the current year (Law 2008-776 of August 04, 2008) as well
as a flat-rate compensation of 40 euros for recovery costs (Decree 2012-1115 of 02 October 2012).
Additional compensation may be claimed, on supporting documents, when the costs
of recovery exposed are greater than the amount of the lump sum indemnity.
8. Ownership and transfer of risk
a) Risk transfer
SkyView Innovation reserves the ownership of the project or other original products
designated on its commercial documents until full payment of their price in principal
and interest. However, the risks are transferred to the customer upon delivery of
the products or upon completion of a service.
b) Intellectual property and copyright
SkyView Innovation's shots are original works protected by law on intellectual property.
Acquiring SkyView Innovation Graphics Images or digital, does not transfer to
the purchaser exclusive property rights that are attached to it; their use is strictly
limited to the private use of the purchaser.
Copyright: Unless otherwise specified, all photographs, films produced
by SkyView Innovation are subject to laws 57-298 of March 11, 1957
concerning ownership and 85-660 of July 3, 1985 on copyright.
Reproduction rights: Any reproduction by any process whatsoever of images or
achievements of SkyView Innovation is prohibited without the prior purchase
of reproduction rights correspondents. The rights are marketed with the digital image
file for use as defined by the customer who mentions when ordering the format,
support and number copies distributed.
The transfer of rights to an image or a creation does not include any exclusivity
character except express mention and, in no case the possibility of transfer of a copy
of the file to third parties free of charge or against payment.
The transfer of rights is acquired by the client only subject to the perfect payment of
these and for the proper use of the images or realizations for the use defined when ordering.
SkyView Innovation and the respective authors of the images reserve the right to refuse
any use of the views for any purpose other than private, unless otherwise stated.
So the author images transfer their copyrights for the dissemination of the current project,
but remain owners copyright for all exceptional uses in another project of these images
and must be kept informed of any negotiations for the reuse of the same images in other
productions, for which the parties, SkyView Innovation / THE AUTHORS, collect royalties
NEGOTIABLE FOR EACH REUSE.
Any use contrary to the above clauses of SkyView Innovation images or creations
without prior agreement will result in a minimum billing of 5 times the value of
the rights correspondents. In order to be able to prove ownership of its images
or creations, SkyView Innovation will keep a digital copy in the original format
from the end shooting operations.
9. Claim
No complaint can be taken into account after a period of 10 days from
the date for the performance of a service or delivery of goods or digital files.
10. Obligations and responsibility of SkyView Innovation
a) Obligations
SkyView Innovation is committed to taking all the care and diligence necessary to supply
quality services in accordance with the practices of the profession and the state of the art.
SkyView Innovation only responds to an obligation of means.
Digital files and original negatives of SkyView Innovation are kept in the best
conditions security, however, SkyView Innovation may refuse a new order in the case
of exceptional from involuntary destruction or alteration occurring to a negative
or a digital file.
SkyView Innovation agrees to keep and provide its customers with a copy of the digital
files or original negatives for a maximum of six (6) months, period beyond of
which the customer becomes solely responsible for the conservation of his data.
b) Limitations
The repairs due by SkyView Innovation in the event of a failure that would result
from a fault established against him will correspond to direct, personal and certain
damage linked to the failure in question, to the express exclusion of any indirect damage
such as, in particular, commercial damage, loss of orders, damage to brand image,
commercial disorder any loss of profits or customers.
In any event, the amount of damages that could be charged to SkyView Innovation
if its responsibility were engaged, will be limited to the amount of the sums actually paid
by the customer for the product or service considered or invoiced or the amount of the sums
corresponding to the price of the service, for the part of the product or the service for which
SkyView Innovation has been held responsible. The lowest amount of these sums
will be taken into consideration.
11. Major force
SkyView Innovation's responsibility cannot be implemented if non-execution
or the delay in the execution of one of its obligations described in the present
conditions terms of sale arises from a case of force majeure. As such, major force
means any external, unforeseeable and irresistible event within the meaning
of article 1148 of the Civil Code.
12. General provisions and applicable law
In case of contrary or contradictory clause with the present general conditions of sale,
it is by mutual agreement that the general conditions of sale above will prevail alone.
a) Modification of general conditions
These general conditions can be modified at any time. Any modification of these general
conditions of sale without the written agreement of SkyView Innovation is void.
The general conditions applicable to the user are those in force on the day of his order.
b) Applicable Law and Jursdiction
The language of the contract is French, any version available in a foreign language
has only one value informative. These general conditions are subject to the application
of French law and the exclusive jurisdiction of French courts.
c) Amicable settlement of disputes
Except in the event of public policy, all disputes that may arise in connection

for amicable settlement do not suspend the deadlines opened for bring legal actions.
d) Divisibility
The invalidity of one of the clauses of these general conditions, in particular in application
of a law, regulation or following a decision of a competent court passed in force of res judicata
can not invalidate all the other clauses that would keep their reach and continue to have their effect.
In this case, the parties should as far as possible replace the canceled provision with a valid
provision as closely as possible to the spirit and purpose of the contractual conditions.
e) No waiver
Failure of the parties to temporarily or permanently take advantage of a or several
clauses of these general conditions, will not in any case entail waiver to take
advantage of the rest of the general conditions.

Flight Scenarios
Scenario S1
S1 is the simplest scenario which requires no authorization only if its rules
are followed to the letter. This is a visual flight, outside a populated area,
and at a maximum of 200 meters from the remote pilot. The weight of the drone
must not exceed 25kg.
Scenario S2
Flights in S2 are limited to 50m in height but at a horizontal distance of 1km.
If the drone weighs less than 2kg then it will be exceptionally authorized
to fly up to 150 meters high.
The DJI Mavic 2 Pro is particularly suitable for this type of mission with
its weight less than 2kg and its significant autonomy.
Drones must however be equipped with an optional circuit breaker module
to claim to S2 approval. It is therefore possible to pilot without seeing
your aircraft provided that to be outside populated areas.
In any case, prior authorization from the DGAC is necessary for this type of flight.
Scenario S3
The S3 is the only scenario that allows you to fly in populated or sensitive areas
and in built-up areas. The S3 scenario is accessible to drones without a parachute
weighing less than 2kg. Beyond this mass and this up to 8kg, it will be necessary
to equip your drone with a circuit breaker system and a parachute.
From 4kg the circuit breaker and the parachute must work with a power supply
and an independent transmitter. The pilot must be able to provide a certificate
which has been issued to him by the prefecture in the event of an inspection,
a specific DSAC IR authorization.
The Inspire 2 was specially designed to practice on this scenario.
Scenario S4
The 4th and last scenario is the most specific of all because there is no distance limit
horizontal provided that it does not exceed 150 meters in height outside built-up areas.
This is an uncommon scenario which requires manned pilot training.
Very few people are qualified and authorized to carry out this type of flight.
They are generally aircraft type aircraft with long autonomy, for surveillance missions.

used for leisure or competition between model aircraft.
Category B
Leisure model aircraft weighing more than 25kg or not respecting
